Terms of Service

These terms are an agreement between you and EzPanda Inc. ("EzPanda", "we") for the Lefty app, the Lefty Plus subscription and this website (together, "Lefty"). By using Lefty you agree to them. If you don't agree, don't use Lefty.

The part that matters most: Lefty is a route-planning aid. It does not detect other vehicles, cyclists or pedestrians, it does not know what you can see, and it never tells you that a turn or a road is safe. You are the driver. You must observe traffic, obey the law and make every driving decision yourself, exactly as you would without the app.

1. What Lefty is

Lefty plans driving routes that reduce certain risk factors, such as unprotected left turns and undivided high-speed roads, and shows you the trade-off against the fastest route. Route suggestions are estimates based on public map data, municipal data and information contributed by other drivers. That data can be incomplete, out of date or wrong. Roads change, signals change, and construction happens.

2. Your responsibilities

Drive lawfully and attentively. Set up your trip while parked. Mount the phone securely. Do not interact with the screen while the vehicle is moving except as permitted by law.
Treat every route as a suggestion. If a suggested manoeuvre is unsafe or unlawful in the moment, do not perform it.
Answer the arrow question, or make a report, only while stopped or as a passenger.
Provide honest reports. Deliberately false reports may lead to your device being excluded from contributing.
You must be at least 17 and legally permitted to drive, or be a passenger.

3. No safety guarantee

Lefty does not guarantee that any route, turn or road is safe, or safer than any other, in any particular instance. The absence of a warning, a lower risk rating, or the selection of a "Lefty route" is not a representation about safety. Statistics we publish describe routing outcomes on map data, not crash outcomes.

4. Lefty Plus subscription

Lefty Plus is an auto-renewing subscription sold through Apple's App Store. Prices are shown in the app before purchase and are charged to your Apple ID.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel in iPhone Settings › Apple ID › Subscriptions.
Refunds are handled by Apple under its policies. See our refund policy.
We may change the price of future renewals with notice through the App Store; you can cancel before the change takes effect.
Features included in Plus may change as the product develops. Where a feature is described as "when it launches", it is not yet available.

5. Contributions

Reports and arrow answers you submit are anonymous map contributions. You grant EzPanda a perpetual, worldwide, royalty-free licence to use, combine, publish and sub-license them, including contributing derived facts (for example, "this intersection has a left-turn arrow") to open map projects such as OpenStreetMap under their licences. You confirm you have the right to make the report.

6. Acceptable use

Don't reverse engineer, scrape, overload or attack the service; don't use Lefty for any unlawful purpose; don't submit automated or false reports; don't resell access. We may suspend access that breaches these terms.

7. Intellectual property

Lefty, its name, logo, software and content belong to EzPanda or its licensors. Map data is © OpenStreetMap contributors, available under the Open Database Licence. Toronto signal data is used under the Open Government Licence – Toronto. Apple, App Store and CarPlay are trademarks of Apple Inc.

8. Disclaimer of warranties

Lefty is provided "as is" and "as available". To the fullest extent permitted by law, EzPanda disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted or error-free operation.

9. Limitation of liability

To the fullest extent permitted by law, EzPanda and its directors, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss, injury, death, property damage, fine or penalty arising from driving decisions, from reliance on route suggestions or data, or from unavailability of the service. Where liability cannot be excluded, it is limited to the greater of the amount you paid EzPanda in the twelve months before the claim and CAD $50. Nothing in these terms limits liability that cannot be limited under applicable consumer protection law, including Ontario's Consumer Protection Act.

10. Changes to Lefty and to these terms

We may change or discontinue features. We may update these terms; the current version is always at this address and material changes will be noted in the app. Continued use after a change means you accept it.

11. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Courts located in Toronto, Ontario have exclusive jurisdiction, subject to any non-waivable right you have to bring a claim in your home jurisdiction.
